Elaine T. Byszewski, Partner
Elaine Byszewski graduated summa cum laude from USC in 1999 and cum laude from Harvard Law School in 2002. After working two years at Jones Day (2002-2004), Elaine joined Hagens Berman where she litigated against corporate wrongdoing for over twenty years (2004-2025). Elaine served as the managing partner of the firm’s Los Angeles office, as well as a member of the firm's Management Committee for its domestic offices until she retired from the firm in 2026.
At Hagens Berman, Elaine represented direct and indirect purchasers in complex antitrust and consumer class actions resulting in billions of dollars of settlements, including cases against major protein producers, car manufacturers, and drug manufacturers. Elaine was a critical team member and primary drafter of nearly all briefs in Edwards v. Nat’l Milk Producers Fed., No. 11-cv-04766 (N.D. Cal.), from complaint filing to settlement of $52 million and received the American Antitrust Institute’s 2018 award for Outstanding Antitrust Litigation Achievement in Private Law Practice. Elaine drafted the petition for en banc review in Hyundai & Kia Fuel Economy Litig., No. MDL 13-2424 (C.D. Cal.), which was granted and resulted in affirmance of the nationwide class action settlement in 2019. See In re Hyundai & Kia Fuel Economy Litig., 926 F.3d 539 (9th Cir. 2019). Elaine was also a chief brief writer on the litigation team that settled In re: Toyota Motor Corp. Unintended Acceleration Mktg., Sales Practices, & Prods. Liab. Litig., No. 8:10-MDL-2151 JVS (C.D. Cal.), for $2 billion and was a finalist for Public Justice’s 2014 Trial Lawyer of the Year award.
Over the past decade, much of Elaine’s work focused on price-fixing and wage-fixing cases. For example, Elaine was part of the Hagens Berman team that served as co-lead counsel for the indirect purchaser class in In re Pork Antitrust Litig., No. 18-CV-01776 (D. Minn.), with recovery of over $100 million. And Elaine was part of the Hagens Berman team that served as co-lead counsel for the indirect purchaser class in In re Broiler Chicken Antitrust Litig., No. 16-CV-08637 (N.D. Ill.), with recovery of over $200 million.
Now Elaine has joined forces with one of her former Hagens Berman partners to serve members of her community impacted by the Eaton Fire. Together, they hope to make a positive difference in the lives of fire survivors.
